Joshua Moylan

Joshua Moylan

Senior Associate Attorney

Joshua joined Benjamin Roberts Law after spending the first phase of his career in insurance defense, where he represented carriers in personal injury and commercial liability disputes. That background taught him something most plaintiff’s attorneys never learn firsthand: how insurance companies build their cases, what motivates them to settle, and—more importantly—what convinces them they can get away with undervaluing a claim.

Now, Joshua uses that knowledge exclusively for injured clients. His approach is built on a reality he observed repeatedly from the defense side: carriers pay full value only when the claim in front of them is thoroughly prepared and the attorney behind it has the ability to take the case further if necessary. Joshua handles complex pre-litigation and litigation files at the firm, working closely with Ben on serious injury matters involving 18-wheeler trucks and other commercial vehicle wrecks, multi-vehicle highway crashes, slip-and-fall and unsafe premises claims, negligent security incidents, and traumatic brain and catastrophic injuries.

He understands that a serious injury impacts more than medical expenses. It affects careers, families, and long-term financial stability. His strategy centers on developing clear liability evidence while presenting a comprehensive damages model that reflects the true human and economic impact of the harm. Most of his cases resolve through negotiation, but insurance carriers know that when Joshua is involved, an inadequate offer will not be the end of the conversation.

Joshua attended Texas Tech University, where he pursued studies in Business Management and Accounting. His business and financial background strengthens his ability to evaluate complex damages, lost earning capacity, and insurance valuation issues in serious injury litigation. He earned his Juris Doctor from South Texas College of Law Houston, graduating magna cum laude. Joshua is licensed to practice law in the State of New Mexico, State of Arizona, and all Courts in the State of Texas. He is also admitted to practice before the United States District Courts for the Southern, Eastern, Northern, and Western Districts of Texas.
