1. Program Description
Benjamin Roberts Law, PLLC ("the Firm," "we," "us") operates a text-messaging program used to communicate with individuals who have contacted the Firm about a potential legal matter and with current clients. Messages are service-related and may include acknowledgment of your inquiry, appointment and consultation reminders, case-status updates, requests for documents, records, or information, deadline reminders, and replies to messages you send us.
2. Consent to Receive Messages
By providing your mobile telephone number to the Firm and affirmatively electing to receive text messages — by checking the SMS consent box on one of our forms, by texting us first, or by giving us express permission in writing or during a call — you consent to receive text messages from the Firm at that number, including messages sent using an automatic telephone dialing system or similar technology. Consent to receive text messages is not a condition of any purchase, of the Firm's evaluation of your matter, or of the Firm's representation of you.
3. Message Frequency
Message frequency varies. It depends on the status of your inquiry or matter and on how often you communicate with us. You should expect to receive messages only when there is something in your matter that requires your attention or a response to a message you have sent.
4. Cost
Message and data rates may apply. The Firm does not charge for text messages, but your mobile carrier's standard messaging and data charges will apply according to your plan. Contact your carrier for details about your plan.
5. How to Opt Out
You may cancel at any time by replying STOP to any text message you receive from us. After you reply STOP, you will receive one final message confirming that you have been unsubscribed, and you will receive no further text messages from the Firm unless you opt in again. You may also opt out by calling 713.609.1898 or emailing ben@benjaminrobertslaw.com. Opting out of text messages will not affect the Firm's handling of your inquiry or your matter; we will continue to contact you by telephone, email, or mail as appropriate.

7. Supported Carriers and Carrier Liability
Carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission by your wireless carrier and is outside the Firm's control. The Firm is not responsible for messages that are delayed, misdirected, or not delivered.
8. Privacy
Your mobile number and your consent to receive text messages are used only by the Firm to communicate with you. We do not share your mobile information with third parties or affiliates for marketing or promotional purposes, and text messaging originator opt-in data and consent are not shared with any third parties under any circumstances. 9. Change of Mobile Number
Please notify the Firm promptly if your mobile number changes or is reassigned, so that we do not send messages about your matter to a number you no longer control.
10. No Attorney-Client Relationship
Text messages exchanged with the Firm do not create an attorney-client relationship. An attorney-client relationship is formed only upon execution of a written engagement agreement. Text messaging is not a secure or reliable method for sending confidential or time-sensitive information, and it should never be used to communicate an emergency or a filing deadline.
11. Changes to These Terms
We may revise these SMS Terms and Conditions from time to time. Revisions take effect when posted, and the "Last Updated" date above will change accordingly.
